at what age did diane ball write this song in 1941?
Where did you get that year from? I have it as 1978, but I suppose that is a copyright date with a publisher, so maybe it was written before that?
(interesting to note that our blog is the number 1 hit in google for "In His Time")
I find the date it was posted much more meaningful than the date it was written... and yes, I noticed the google ranking too. I guess that shows one of google's weaknesses: the top hit is not necessarily the most informative.
May I have your permission to copy the words of this song in a book I am writing for Papua New Guinea? I will give your name and date with it.
You would have to talk with the copyright holder, which is not me. (and perhaps they wouldn't want me to publish it here either, but I usually figure people like their stuff published to further more interest in their work, but maybe that's just because I believe in open source)
My suspicion is that people like their stuff published even better if you provide a link to where someone could buy their stuff.
That said, I'm not sure anyone's ever going to sue you over this blog post. The Wikipedia entry on Fair Use cites US law as follows:
Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
2. the nature of the copyrighted work;
3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4. the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.
You're probably in trouble with #3 but probably out of trouble with #4 - though with this blog entry near the top of Google on searches for "in his time diane ball" I might be wrong.
Now, if you are making money from this blog post, you're definitely in trouble - but I'll wager that making money off these lyrics was the furthest thing from your mind when you posted it.
